Supreme Court Issues Notice On Another Petition Filed By Teesta Setalvad's NGO CJP Challenging Anti-Conversion Laws Of 5 More States
On January 22, 2021, the Supreme Court issued a notice on a second petition filed by NGO Citizens for Justice and Peace (CJP), led by activist Teesta Setalvad, against the anti-conversion laws of five more states- Uttar Pradesh, Himachal Pradesh, Jharkhand, Chhattisgarh and Uttarakhand.
The NGO had sought scrapping of the anti-conversion laws in these states claiming that they violate fundamental rights guaranteed by Articles 14 and 25 of the Indian Constitution.
In the petition, CJP stated that the anti-conversion laws are primarily used to target minority communities. They argued that these laws discriminate on the basis of religion and restrict one’s freedom of choice.
The petition further stated that the anti-conversion laws load the burden of proof on the accused and demanded that these laws be declared unconstitutional in order to protect the lives and personal liberties of individuals.
The Supreme Court has sought responses from the five states within four weeks. A similar petition was filed in April 2020 challenging the anti-conversion laws of Madhya Pradesh, Arunachal Pradesh, Gujarat, and Odisha.
